Welcome to Zence Design (“we”, “us”, “our”). We operate the website www.zencedesign.com (the “Site”) and provide all related information, content, features, tools, products, and services (collectively, the “Services”) to offer curated modern home essentials.

Our store is powered by Shopify Inc. (“Shopify”), which enables us to provide the Services to you.

These Terms of Service (“Terms”) govern your access to and use of the Services, together with any policies referenced herein, including our Privacy Policy, Refund Policy, and Shipping Policy.

By accessing, browsing, or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

Section 1 – Access and Account

By using the Services, you confirm that you are at least the age of majority in your jurisdiction or are using the Services under the supervision of a parent or legal guardian.

To place an order, you may be required to provide personal information including your name, email address, billing address, delivery address, and payment details. You agree that all information provided is accurate, complete, and current.

You are responsible for maintaining the confidentiality of your account information and for all activities conducted under your account.

Section 2 – Products

Zence Design offers curated home essentials including glassware, ceramic mugs, incense holders, drinkware, trays, coasters, and related lifestyle products.

We make every effort to display product images and descriptions accurately. However:

  • Colors may vary depending on your screen or device.
  • Product appearance may slightly differ from images shown.
  • All product descriptions and prices are subject to change without notice.
  • We reserve the right to discontinue any product at any time.
  • We may limit quantities per customer or order.

Section 3 – Orders

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion.

An order is considered accepted only once payment has been successfully processed, or confirmed for Cash on Delivery where available, and you receive an order confirmation email.

We may cancel or modify an order if there are pricing errors, stock issues, suspected fraud, or operational limitations.

Products are intended for personal use only and may not be resold without our written consent.

Section 4 – Pricing and Payment

All prices are listed in AED unless otherwise stated.

Prices do not include applicable taxes, delivery fees, or Cash on Delivery service fees unless clearly stated.

We reserve the right to modify pricing at any time without prior notice.

You agree to provide valid and authorized payment information. By placing an order, you represent that:

  • You are authorized to use the payment method provided.
  • The information submitted is accurate.
  • You will pay all charges incurred, including delivery fees, Cash on Delivery service fees, and applicable taxes.

Section 5 – Shipping and Delivery

Zence Design currently delivers within the United Arab Emirates (UAE) only.

Delivery fees, delivery timelines, and conditions are outlined in our Shipping Policy available on the Site.

UAE orders may qualify for free UAE delivery based on the order value shown in our Shipping Policy and at checkout.

Shipping fees, if applicable, and estimated delivery timelines are displayed at checkout before purchase.

Delivery times are estimates only and are not guaranteed.

We are not liable for delays caused by:

  • Shipping carriers or courier service disruptions
  • Incorrect or incomplete address information
  • Customer unavailability at delivery time
  • Weather conditions
  • Force majeure events

Risk of loss transfers to you once the order has been handed to the shipping carrier or courier.

Section 6 – Damaged Items / Breakage Policy for Fragile Products

Many of our products, including glassware and ceramics, are fragile. We take special care in packaging all orders.

If your order arrives damaged or broken, you must contact us within 48 hours of delivery.

To process a damage claim, you must provide:

  • Your order number
  • Clear photos of the damaged item(s)
  • Clear photos of the outer shipping box
  • Clear photos of the inner packaging

Claims submitted without sufficient photo evidence may be declined.

We reserve the right to determine whether a replacement, store credit, or refund will be issued based on the situation and product availability.

Damage claims submitted after 48 hours from delivery may not be accepted.

Minor imperfections, slight color variations, or small manufacturing differences do not qualify as defects.

Section 7 – Cash on Delivery (COD)

We offer Cash on Delivery (COD) within the UAE.

If you select COD at checkout:

  • An additional AED 10 COD service fee applies.
  • Payment must be made in full at the time of delivery.
  • Someone must be available to receive and pay for the order.

Refusal to accept or pay for a COD order may result in order cancellation and restriction of future COD eligibility.

If a COD order is returned due to refusal, failed delivery attempts, or incorrect address details, we reserve the right to charge delivery costs or deny future COD orders.

Section 8 – Intellectual Property

All content on the Site, including logos, branding, images, graphics, product descriptions, designs, and layout, is owned by or licensed to Zence Design and protected by intellectual property laws.

You may use the Services for personal, non-commercial purposes only.

You may not reproduce, distribute, modify, or exploit any content without prior written consent.

All rights not expressly granted are reserved.

Section 9 – Third-Party Tools and Links

The Site may include third-party tools or links. These are provided “as is” without warranties of any kind.

We are not responsible for third-party content, websites, or services accessed through our Site.

Section 10 – Relationship with Shopify

Zence Design is powered by Shopify. However, all sales are made directly between you and Zence Design.

Shopify is not responsible for any aspect of transactions conducted through our store, including products sold, order fulfilment, delivery, returns, refunds, or customer service.

Section 11 – Privacy Policy

Because our store is hosted by Shopify, Shopify may also collect and process personal information to operate and improve the Services.

By using the Services, you acknowledge that you have read and understood our Privacy Policy.

Section 12 – Errors and Inaccuracies

We reserve the right to correct typographical errors, pricing mistakes, inaccuracies, or omissions at any time and to cancel or modify orders if necessary.

Section 13 – Prohibited Uses

You may not use the Services:

  • To transmit malware or malicious code

  • To interfere with the security or functionality of the Site

Violation may result in termination of access.

To the fullest extent permitted by UAE law, Zence Design disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Zence Design shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services or products purchased through the Site.

Nothing in these Terms excludes liability where such exclusion is not permitted under applicable law.

Section 16 – Indemnification

You agree to indemnify and hold harmless Zence Design, Shopify, and their affiliates from any claims, liabilities, damages, or expenses arising from:

  • Your breach of these Terms
  • Your violation of law
  • Your misuse of the Services

Section 17 – Termination

We may terminate or suspend access to the Services at any time without notice if you violate these Terms.

Provisions that by their nature should survive termination shall remain in effect.

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.

Any disputes shall be resolved exclusively in the courts of the UAE.
